REIA Annual Law Update

   
The REIA Annual Law Update is a mix of existing laws, ordinances and rules that impact real estate investors along with a recap of some of the more common legal pitfalls that can make us easy prey for problems.
REIA Annual Law Update on Monday, August 12, 2019  

Our attorney panel will be comprised of four attorneys who are active in REIA, some of whom are also real estate investors.

Fellow REIA Members and Washington Attorneys Ben Cushman of Deschutes Law Group, Scott Hildebrand Attorney at Law, Jack Orr of the Law Offices of Jack G. Orr, Inc. PS and Scott Scher of Sternberg Thomson Okrent & Scher, PLLC will team up for this year's law update.

  • the Distressed Property Conveyance Act, a Washington law that can put you at risk of lawsuits AND be a felony!
  • Landlord / Tenant and Eviction matters, all recently changed

About Our Speakers

Ben Cushman, a fellow REIA Member, attorney and principal of the Deschutes Law Group, PLLC, is a native of Washington and his family has been in the region for more than 100 years. He received his B.A. in Philosophy before graduating from Lewis and Clark Law School.

Ben has been licensed to practice law since 1996. His is a client-centered firm that handles litigation and transactional matters for businesses and individuals. His focus is on real property, construction and related contracts and liens, commercial contracts, business formation, landlord-tenant matters, creditor-debtor, and education law including getting appropriate education for special needs children from the school systems.

In addition to many other real property matters, Mr. Cushman has expertise in easements, permits, zoning issues, land use and land use litigation. Ben will serve as a REIA educator on several of these topics at an all-day class offered by REIA on Land Development later this year.

Scott Hildebrand is a fellow REIA Member, attorney and government affairs consultant in the Puget Sound. His law practice emphasizes business formation and real estate transactional issues. As a government affairs consultant, he represents various entities in the construction space at local and state governments. Previous to establishing his solo legal practice,

Scott was Director of Public Policy and Association Counsel for the Master Builders Association of King and Snohomish Counties. In that capacity, he represented the largest local home builders association in the nation.  Scott has had a hand in writing legislation including amendments to the Washington Condominium Act, and bills addressing various aspects of property development, construction and construction liability.

Scott holds a Juris Doctor degree from Concord University and is licensed to practice law in Washington and California as well as the US District Court in the Western District of Washington. He is the Past Chair of the Multifamily Housing Committee of the American Bar Association. He has written briefs on a number of land development cases at various levels and has had one brief accepted by the Washington Supreme Court.

Jack Orr is a fellow REIA Member who served as past counsel for the Washington State Securities Division. Serving as Registrations Counsel, Mr. Orr reviewed and commented on applications to register securities for sale in the State of Washington, including offerings for amounts in excess of $50,000,000. He also served as Enforcement Counsel, investigating and prosecuting violators of the Washington State Securities Act.

Mr. Orr has since been in the private practice of law, with emphasis in real estate related matters including syndications and other types of real estate financing, joint ventures, business and corporate organization, real estate planning, securities registration and compliance. He has been the lead counsel on securities offerings with an aggregate total over $500,000,000.

Jack Orr was admitted to practice law
in Washington State in 1976. He is a 1976 graduate of the University Of Puget Sound School Of Law and holds a Bachelor of Arts in Business Administration from the University of Washington.  He currently practices in his own firm, Law Offices of Jack G. Orr, Inc. P.S.

Mr. Orr serves as a lecturer at continuing professional education seminars for attorneys, law firms, accountants, business education and development groups, technology companies, securities broker dealers and real estate developers in the areas of securities compliance, issuer registration issues, securities litigation, capital funding, broker dealer compliance and has testified as expert witness on securities related matters in various legal proceedings.

Scott R. Scher is a fellow REIA Member, attorney and Founding Partner of the law firm of Sternberg Thomson Okrent & Scher, PLLC. Mr. Scher has practiced commercial and residential real estate law for more than 20 years and has negotiated more than $100 Million in real estate transactions throughout his career. 

Mr. Scher’s practice includes negotiating and drafting commercial and residential purchase and sale agreements, financing agreements for buyers and sellers, and loan workouts and modifications for investors and lending institutions. Mr. Scher’s firm also represents clients with regard to real estate disputes that relate to purchase and sale agreements, escrow and title issues, and commercial leases.

A graduate of Seattle University School of Law,
 Mr. Scher was named one of Seattle Metropolitan Magazine’s “Top Lawyers”, is rated Rated AV (Highest Rating) by Martindale-Hubbell National Attorney Rating Service, is a licensed real estate broker, a member of the Commercial Brokers Association, served as a Member of the NWMLS Arbitration and Disciplinary Panel (2008-2015), serves as a King County Superior Court Arbitrator and has been admitted to the bar of the United States Supreme Court.  Mr. Scher served as lead counsel for real estate investors in Jametsky v. Olsen, the seminal Washington Supreme Court case concerning RCW 61.34, the Washington Distressed Property Conveyance Act.


Scott and his wife Sarah have a 9 year old son and a toddler that keep them very busy. He also enjoys traveling the world, surfing (only in warm water!), and attending Seahawks and Sounders games.

Directions: From 405 North or South go WEST on NE 8th; turn RIGHT (or north) into the Bellevue Place Parking Garage (pass 106th Ave NE, pass Chase Bank and turn into the garage BEFORE Bellevue Way NE and Bellevue Square). If you MISS the turn into the Parking Garage, turn RIGHT onto Bellevue Way NE and RIGHT into the Bellevue Place Parking Garage. Once in the Hyatt use the Olympic Tower Elevator (to the northeast, or right, of the front desk in the "new" tower near the Evergreen Ballroom). The Auditorium is on the third floor. REIA's meeting room is visible from the elevator. There will be electronic and other signage directing you to the Auditorium for the REIA Meeting. Parking: you will take a ticket when entering the parking garage. Validation is available for up to three hours AND the gate is lifted at 8:00 PM making self parking complimentary for the majority of REIA attendees.
